Adult Article 81 guardianship proceedings are filed in Supreme Court, Bronx County — not Surrogate’s Court. Incapacity must be proven by clear and convincing evidence, and any powers granted must reflect the least restrictive intervention tailored to the individual’s actual needs.

Before petitioning, courts expect families to have considered alternatives to guardianship such as a Durable Power of Attorney (GOL §5-1513), Health Care Proxy, or Supported Decision-Making.
